1. Acceptance of Terms

By accessing or using the StreetSmarts platform — including our website, report generation service, agency portal, and any related products operated by StreetSmarts ("StreetSmarts", "we", "us", or "our") — you agree to be bound by these Terms and Conditions ("Terms").

If you do not agree with any part of these Terms, you may not use our services. These Terms apply to all users, including buyers, registered users, agency accounts, and agents acting on behalf of an agency.

By creating an account or purchasing a report, you confirm that you are at least 18 years old and legally able to enter into a binding agreement under South African law.

2. Services

StreetSmarts provides on-demand neighbourhood area analytics reports ("Reports") and area comparison reports ("Comparison Reports") based on data sourced from licensed third-party data providers. Reports may include:

• Property sales and bond activity within a radius of a selected address
• Deeds ownership information
• Postal code analysis and boundary insights
• Travel-time band modelling
• Area traffic and commute congestion data
• Points of interest and amenity proximity
• Property crime statistics (sourced from published government data)
• Consolidated narrative summaries for Comparison Reports

We do not guarantee the completeness, accuracy, or real-time currency of any data contained in a Report. Reports are provided for informational purposes only and do not constitute professional property valuations, legal advice, or investment advice.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

3. User Accounts

To generate a Report or access certain features you must register for an account. Authentication is handled via secure magic links sent to your registered email address. You agree to:

• Provide accurate and complete registration information
• Keep access to your registered email account secure, as it is the sole method of authentication
• Notify us immediately of any unauthorised access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms, are associated with fraudulent activity, or have been inactive for an extended period. You may delete your account at any time by contacting us.

4. Payment & Credits

Reports and Comparison Reports are purchased individually or as pre-paid credit bundles. All prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable.

Online payments are processed securely through Paystack. Agency accounts may also pay via EFT (electronic funds transfer). By completing a purchase you authorise us to charge the stated amount. We do not store full payment card details on our servers.

Purchased credits are non-transferable between user accounts and do not expire. Generated reports are valid for 90 days from the date of generation. Agency credit allocations are governed by the agency's account agreement.

Refund requests are assessed on a case-by-case basis. For full details, see our Refunds Policy.

5. Reports & Data

Reports generated on the StreetSmarts platform are produced using aggregated data from licensed third-party providers. As such:

• Data accuracy is subject to the currency and quality of upstream data sources
• We make no warranties as to fitness for a particular purpose
• Reports should be considered as one input among multiple in any property decision
• We are not liable for decisions made on the basis of Report data

You may share Reports with third parties using our built-in share link feature. Share links may be set to expire. Reports also include a QR code and verification URL that allow recipients to confirm the report's authenticity. You are responsible for the appropriate use and distribution of any Report you access.

You may not resell, redistribute commercially, or reverse-engineer Report data without our prior written consent.

6. Intellectual Property

The StreetSmarts platform, its design, software, brand assets, and the compiled presentation of Report content are the intellectual property of StreetSmarts, or licensed to us by third parties.

You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for personal or internal business purposes in accordance with these Terms. No ownership or IP rights are transferred to you.

Any feedback, suggestions, or ideas you provide to us may be used by us without obligation to you.

7. Prohibited Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable South African law
• Attempt to gain unauthorised access to any part of the platform or another user's account
• Scrape, crawl, or systematically extract data from the platform without written authorisation
• Use Report data to build a competing data product or service
• Impersonate any person or entity or misrepresent your affiliation
• Transmit any malicious code, virus, or disruptive content through the platform
• Circumvent any technical measures we put in place to protect the service

8. Limitation of Liability

To the maximum extent permitted by applicable law, StreetSmarts and StreetSmarts shall not be liable for:

• Any indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Errors or inaccuracies in third-party data included in Reports
• Service interruptions or downtime
• Decisions made in reliance on Report content

Our total liability to you for any claim arising from use of the platform shall not exceed the amount paid by you in the 90 days preceding the claim.

Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under South African law.

9. Agency Accounts

Estate agencies and property professionals may apply for an agency account. Approval is at our discretion. Agency accounts operate under these Terms plus any supplementary agency agreement provided at the time of onboarding.

Agency administrators are responsible for all activity of agents and team members under their account. Credits allocated to an agency account may not be transferred out of that account.

Co-branded reports generated through an agency account remain the property of StreetSmarts and may only be distributed to end buyers for the purpose of neighbourhood area analysis.

10. Termination

We may suspend or terminate your access to the platform immediately and without notice if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law.

On termination, your right to access the platform ceases. We may retain your account data for a period required by law or legitimate business purposes. Unused purchased credits are non-refundable on termination for breach.

You may terminate your account at any time by contacting us. Unused credits at the time of voluntary termination are subject to our Refunds Policy.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising under these Terms shall be subject to the jurisdiction of the South African courts.

We will endeavour to resolve disputes amicably in the first instance. You may also contact us directly before initiating formal proceedings.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by email or by a prominent notice on the platform. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.

The effective date at the top of this page indicates when these Terms were last updated.
